A new
Law Amending Certain Acts No.7226 was published in the repeating Official
Gazette No. 31080 dated March 26, 2020 which amends the article 64 of Labor Law
No.4857. Accordingly, in cases where the work is stopped due to; inter alia, compulsory reasons which
leads the workplace to operate below normal working hours and time off upon the
request of the employee, the employer is entitled to demand for compensatory
work for off days within four months ( instead of two) subsequent to compulsory
reasons. In addition, it is stated that the President of the Republic of Turkey
is authorized to increase this period up to 8 months. It should be noted that
the compensatory work does not count as overtime provided that it does not
exceed three hours a day or the maximum working time per day and does not be
done on holidays.
